Man ordered to return Dh99,000 mistakenly transferred to his account

An Abu Dhabi court has ordered a man to return Dh99,000 that was mistakenly transferred to his bank account and pay an additional Dh20,000 in compensation.

The case was filed by a company owner who said the defendant was one of his customers and that his bank-account details had been saved in the plaintiff’s banking application.

The plaintiff said he accidentally transferred Dh99,000 to the customer’s account and repeatedly asked him to return the money after discovering the mistake. However, the defendant allegedly delayed and refused to repay it.

Court records showed that the man withdrew Dh95,000 of the amount through an ATM in two instalments. He was subsequently convicted in a related criminal case.

The Abu Dhabi Court for Family, Civil and Administrative Claims found that the criminal judgment had established the defendant’s responsibility and that he remained liable for the full amount.

The court also found that the plaintiff had suffered material damage through the loss of access to his money and potential profits, as well as moral harm caused by distress and anxiety.

The defendant was ordered to return the Dh99,000, pay Dh20,000 in compensation and cover the court fees and expenses.
